Right of withdrawal
1. When purchasing products, the consumer has the option to dissolve the agreement without stating reasons within 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or a representative designated in advance by the consumer and made known to the entrepreneur.
2. During the cooling-off period, the consumer shall handle the product and its packaging with care. He shall only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he shall return the product to the entrepreneur with all supplied accessories and - if reasonably possible - in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.
3. If the consumer wishes to exercise his right of withdrawal, he is obliged to notify the entrepreneur of this within 14 days after receipt of the product. This can be done by email, whether or not using the model form. After the consumer has indicated that he wishes to exercise his right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the delivered goods were returned in time, for example by means of proof of shipment.
4. If the customer has not indicated, after expiry of the periods referred to in paragraphs 2 and 3, that he wishes to exercise his right of withdrawal, or has not returned the product to the entrepreneur, the purchase is final.
5. If the consumer exercises his right of withdrawal, at most the costs of return shipment shall be borne by him.
6. The consumer is responsible for ensuring that the product to be returned is packed sufficiently securely and protectively before handing it over to the carrier, in order to prevent damage during transport.
7. A product shall only be deemed "returned" when it is delivered to the entrepreneur in undamaged and unused condition. Until receipt by the entrepreneur, the product remains in the possession of the consumer. The entrepreneur does not accept returns that have been damaged during transport from the customer to the entrepreneur.
8. If the consumer has paid an amount, the entrepreneur shall repay this amount as soon as possible, but no later than within 14 days after withdrawal. This is subject to the condition that the product has already been received back by the online retailer or conclusive proof of complete return shipment can be provided.
9. The entrepreneur may exclude the consumer's right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, or at least in good time before concluding the agreement.
10. Exclusion of the right of withdrawal is only possible for products:
a. that have been created by the entrepreneur in accordance with the consumer's specifications ('custom-made');
b. that are clearly personal in nature;
c. that by their nature cannot be returned;
d. that can spoil or age quickly;
e. whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;
f. for hygienic products of which the consumer has broken the seal.
11. The right of withdrawal as described in this article applies exclusively to consumers residing within the European Union. For consumers Outside the European Union, no statutory right of withdrawal applies. Returns from outside the European Union are therefore not accepted, unless otherwise agreed in writing in advance by the trader.
